Feature Individual Trustee Corporate Trustee
Legal Status The trust is held in the personal names of individuals. A dedicated proprietary company (Pty Ltd) acts as the trustee.
Liability Individuals are personally liable for trust debts. Liability is limited to the assets of the company.
Succession Assets must be retitled if a trustee dies or changes. Perpetual. Asset titles remain in the company name.
Asset Protection Low. Personal assets are exposed to trust litigation. High. Essential for high-risk mandates or development.
